Hangar Lease Agreement

This lease is between [City or county name] (the Owner) and [Tenant name] of [Tenant mailing address] (the Tenant), for Hangar [Hangar number] at [Airport name].

Terms

  1. Premises. The Owner leases Hangar [Hangar number] to the Tenant, together with the right to use the taxiways and ramps that serve it, in common with others.
  2. Term. The lease starts on [Start date] and runs for [Lease term]. After that it continues month to month until either party ends it with [Notice period in days] days of written notice.
  3. Rent. The Tenant pays [Monthly rent] per month, due on the first day of each month. Rent more than ten days late carries a late fee of [Late fee]. The Owner may change the rent at renewal, using the same rate schedule it applies to similar hangars.
  4. Aircraft. The Tenant will keep aircraft [Aircraft registration number] in the hangar, or another aircraft after telling the Owner in writing. The hangar must hold an airworthy aircraft, or one being actively restored or built, for most of the lease.
  5. Use. The hangar is for aeronautical use first. Small amounts of non-aeronautical storage are allowed only if they do not get in the way of moving, storing or working on the aircraft. Using the hangar as a home, a shop for a non-aviation business, or long-term storage of vehicles or household goods is not allowed.
  6. Maintenance by the Tenant. The Tenant may do the kinds of aircraft maintenance federal rules allow an owner to do, using safe practices. Painting, fuel-tank work and any work with open flame need the Owner's written consent first.
  7. Safety. No fueling, smoking or open flame inside the hangar. Flammable liquids are limited to what fits in properly rated safety containers. The Tenant keeps a working fire extinguisher in the hangar.
  8. Care of the hangar. The Tenant keeps the hangar clean and reports damage or leaks promptly. The Owner keeps the roof, structure, doors and utilities to the hangar in working order. The Tenant pays for damage the Tenant causes.
  9. Changes. The Tenant may not change, wire or build in the hangar without the Owner's written consent.
  10. Inspection. The Owner may inspect the hangar after giving at least 24 hours' notice, and at any time in an emergency. The Owner will review hangar use at least once a year.
  11. Insurance. The Tenant carries aircraft liability insurance of at least [Liability limit amount] and names [City or county name] as an additional insured. The Tenant gives the Owner proof of coverage each year.
  12. Responsibility for claims. The Tenant is responsible for claims arising from the Tenant's use of the hangar, except claims caused by the Owner's own negligence, to the extent the law allows.
  13. Assignment. The Tenant may not sublease or assign this lease without the Owner's written consent.
  14. Rules. The Tenant follows the airport rules and regulations and minimum standards, as they may be updated.
  15. Default. If the Tenant breaks this lease, the Owner will give written notice and [Notice period in days] days to fix it. If it is not fixed, the Owner may end the lease. The Tenant then removes the aircraft and belongings promptly.
  16. Notices. Notices go in writing to the addresses in this lease, or to a new address a party gives in writing.
  17. Whole agreement. This lease is the full agreement. Changes must be in writing and signed by both parties.
