Aircraft Tie-Down Agreement
This agreement is between [City or county name] (the Owner) and [Tenant name] of [Tenant mailing address] (the Tenant), for tie-down spot [Tie-down spot number] on the ramp at [Airport name].
Terms
- Spot. The Owner lets the Tenant park and secure one aircraft at tie-down spot [Tie-down spot number], together with the use of the ramp and taxiways that serve it, in common with others. The Owner may move the Tenant to another spot of similar size for construction, events or safety, after notice when possible.
- Term. This agreement starts on [Start date] and runs month to month. Either party may end it with [Notice period in days] days of written notice.
- Fee. The Tenant pays [Monthly fee] per month, due on the first day of each month. The Owner may change the fee with [Notice period in days] days of written notice, using the same rate schedule it applies to other tie-down tenants.
- Aircraft. The spot is for aircraft [Aircraft registration number], or another aircraft after the Tenant tells the Owner in writing. Only one aircraft may use the spot.
- Securing the aircraft. The Tenant ties down the aircraft at all times when it is parked, using sound ropes or straps at every tie-down point, with wheel chocks in place and control locks installed. The Tenant checks the tie-downs before forecast high winds or storms.
- Owner's equipment. The Owner provides the tie-down anchors and keeps them in working order. The Tenant reports any damaged anchor promptly and does not use it.
- Care of the spot. The Tenant keeps the spot clean and free of loose items, and cleans up any oil or fuel spill right away. No vehicles, trailers or stored items are left at the spot.
- Maintenance. The Tenant may do the kinds of aircraft maintenance federal rules allow an owner to do. No fueling, painting or work with open flame at the spot.
- Insurance. The Tenant carries aircraft liability insurance of at least [Liability limit amount] and names [City or county name] as an additional insured. The Tenant gives the Owner proof of coverage each year.
- Risk. The Owner does not insure, guard or watch the aircraft. The Tenant is responsible for the aircraft and for claims arising from the Tenant's use of the spot, except claims caused by the Owner's own negligence, to the extent the law allows.
- Rules. The Tenant follows the airport rules and regulations, as they may be updated.
- Default. If the Tenant breaks this agreement, the Owner will give written notice and [Notice period in days] days to fix it. If it is not fixed, the Owner may end the agreement, and the Tenant then removes the aircraft promptly.
- Abandoned aircraft. If an aircraft stays at the spot after the agreement ends, the Owner may take the steps state law allows for abandoned property.
- Assignment. The Tenant may not let anyone else use the spot or assign this agreement without the Owner's written consent.
- Whole agreement. This is the full agreement. Changes must be in writing and signed by both parties.
